These Terms & Conditions (“Terms”) govern your access to and use of the website and services operated by Stay Radiant INC (“we,” “us,” or “our”). By accessing our website, booking an appointment, purchasing a service, or otherwise using our Services, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use our Services.
1. Services
Stay Radiant INC provides professional mobile teeth whitening services, delivered at a client’s home or chosen location. Services may include in-session whitening treatments, optional enhancements, aftercare products, memberships, and related booking, communication, and follow-up services.
All services are cosmetic in nature and are not medical or dental treatments.
2. Eligibility
You must be at least 18 years of age to book or receive services, or be accompanied by a parent or legal guardian who provides consent. By using our Services, you represent that you meet these eligibility requirements.
3. Bookings & Appointments
3.1 Appointment Booking
All appointments must be booked through our approved booking system. Availability is subject to change and is not guaranteed until payment is completed.
3.2 Payment
Payment is required at the time of booking to secure an appointment. Appointments are considered confirmed once payment has been successfully processed.
We use third-party payment processors (such as Stripe) to handle transactions. We do not store full payment card details.
4. Cancellations, Reschedules, & No-Shows
4.1 Cancellations & Rescheduling
Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled appointment time.
4.2 No-Refund Policy
All bookings are non-refundable once payment has been completed.
4.3 Missed Appointments
Missed appointments or late cancellations may result in forfeiture of the session, applicable fees, or loss of eligibility for future bookings, at our discretion.
5. Mobile Service & Location Requirements
Clients are responsible for providing an accurate service address at booking. The location must be safe, accessible, and suitable for mobile service delivery.
We reserve the right to refuse or discontinue service if the environment is unsafe, unsuitable, or misrepresented. Additional travel fees may apply for locations outside our standard service area.
6. Results & Disclaimers
Individual whitening results vary based on factors including, but not limited to, natural tooth shade, lifestyle habits, and prior dental history.
We do not guarantee specific results. Our Services are cosmetic only and are not a substitute for professional dental care.
7. Aftercare & Client Responsibility
Clients are responsible for following all aftercare instructions provided. Failure to follow aftercare guidance may affect results, for which we are not responsible.
8. Memberships
8.1 Billing & Renewal
Memberships are billed on a quarterly or annual basis and automatically renew unless cancelled in accordance with these Terms.
8.2 Cancellation
Memberships may be cancelled with 30 days’ notice prior to the next billing cycle. Memberships remain active until the end of the paid period.
8.3 No Refunds
Membership fees are non-refundable once billed.
8.4 Use of Benefits
Membership perks, complimentary sessions, or discounts must be used within the active membership period and do not roll over. Memberships are non-transferable unless otherwise stated.
9. Referral Program
Participation in any referral or rewards program is subject to additional guidelines and eligibility requirements.
Referral rewards:
- Are unlocked only after a referred client completes a paid session
- Have no cash value
- Are non-transferable
- May be revoked in cases of misuse or abuse
We reserve the right to modify or terminate referral programs at any time
10. Intellectual Property
All content on our website, including text, graphics, logos, images, and branding, is owned by or licensed to Stay Radiant INC and is protected by applicable intellectual property laws.
You may not reproduce, distribute, or use our content without prior written permission.
11. User Conduct
You agree not to:
- Use our Services for unlawful purposes
- Misrepresent information when booking
- Abuse promotions, referrals, or rewards
- Interfere with the operation or security of our Services
We reserve the right to suspend or terminate access for violations of these Terms.
12. Third Party Services
Our Services may integrate with or link to third-party platforms (including payment processors, scheduling tools, and analytics providers). We are not responsible for the practices or content of third-party services.
13. Limitation Of Liability
To the fullest extent permitted by law, Stay Radiant INC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.
Our total liability for any claim shall not exceed the amount paid by you for the service giving rise to the claim
14. Indemnification
You agree to indemnify and hold harmless Stay Radiant INC from any claims, damages, losses, or expenses arising out of your use of the Services, violation of these Terms, or infringement of any rights of a third party
